Kentucky car accident law: the four things that matter most

Your own insurance pays first.

Kentucky is a “choice no-fault” state. Your Personal Injury Protection (PIP) coverage pays the first $10,000 of medical bills and lost wages regardless of fault (KRS 304.39). Use it; it does not raise your rates for a crash you didn’t cause.

You can still sue the at-fault driver.

Once your medical expenses exceed $1,000, or you have a broken bone, permanent injury or disfigurement, you may step outside no-fault and pursue the other driver for full damages including pain and suffering (KRS 304.39-060).

The deadline is two years, not one.

Motor vehicle injury claims in Kentucky must be filed within two years of the crash or of the last PIP payment, whichever is later (KRS 304.39-230). Most other Kentucky injury claims allow only one year, so do not rely on general advice.

Being partly at fault does not end your claim.

Kentucky uses pure comparative fault (KRS 411.182). If you were 20 percent responsible, you recover 80 percent of your damages. Insurers exaggerate your share; we correct it.
