Family Files Second Lawsuit in Herrington Lake Case, Alleging Cody Casey Transferred Assets to His Brother to Avoid Paying for the Crash

LEXINGTON, Ky. — August 24, 2026

Peterson Law and Whiteford Taylor & Preston have filed a second civil lawsuit in Mercer Circuit Court on behalf of the family injured in the July 4, 2026 boat collision on Herrington Lake. The new complaint (Case No. 26-CI-00279) names Cody Casey and his brother, Jesse Casey, as defendants.

The lawsuit alleges that in the days after the collision — on or about July 10, 2026 — Cody Casey transferred several vehicles to his brother without receiving fair value in return, while the family’s claims against him were pending or anticipated. The complaint alleges these transfers were made to place assets beyond the family’s reach and to hinder their ability to recover for the deaths and injuries caused by the collision.

The complaint brings claims under Kentucky’s Uniform Voidable Transactions Act, including voidable transfer and civil conspiracy, and asks the court to undo the transfers, freeze the assets, and hold both brothers responsible. A jury trial has been demanded.

The filing follows the family’s original lawsuit against Cody Casey (Case No. 26-CI-00267) and this month’s 19-count grand jury indictment against him.
