Justin Peterson Representing Victims of Nicholas Co. Crash, Challenging Suspect’s Story

Detailed in a local news story on WKYT, Justin Peterson of Peterson Law Office is representing the victims of a deadly car crash that happened in Nicholas County on June 3rd, 2023. The victims being represented are Emily Earlywine and Dylan Saucedo, as well as the estates of Gage Gaunce, 20, and Clay Welch, 17. The victims are suing Cheyeene Clifford, 25, who is charged with 11 counts in connection to the crash. Two individuals died in the crash and two others were injured. Clifford’s insurance company and the owners of the bar that the group went to that night are also being sued.

In an interview last month, Clifford downplayed how much he had to drink and stated that he was not driving at the time of the accident. Peterson Law Office has helped uncover new evidence and testimony showing that these statements may not be true. There are several new developments in the case now, including evidence showing that Clifford was pulled over for drinking and let go with a mere warning less than two hours before the crash occurred. Additional evidence shows that there were multiple opportunities– including opportunities by the bar owners– to stop Clifford from getting behind the wheel that night when he was extremely intoxicated, but actions weren’t taken on those opportunities.

Under these circumstances, bar owners have a legal duty to take actions to prevent intoxicated drivers from getting behind the wheel. Doing so can prevent deadly car accidents caused by alcohol.

When asked about the civil lawsuit, Justin Peterson said, “We feel very strongly that, once all of that evidence is made known, there will be accountability for those who should be held accountable.”

One motion in the civil lawsuit happened earlier this week. Another is scheduled for January 9th.
